Caught in the Act - Recording Sexual Harassment with Cell Phones in Florida

A client recently came to me complaining of sexual harassment by her doctor. She videotaped her interaction, recording comments that were very unprofessional, and his grabbing her in lewd fashions. In today’s climate of #METOO, we have an abundance of women coming forward to report the harassment they have experienced from predators. Under Florida law, sexual harassment is a violation of your civil rights.

America’s endemic culture of sexual harassment exclusively committed by men against women must not be lost or swept away. Women fear retaliation, indifference or disbelief if they speak up. Things are hard for women with no economic or political power. The consequences to the harassers must be swift and clear. We must treat sexual harassment seriously because it is wrong for anyone to endure such oppressive treatment.

The elements of a permanent cultural shift are certainly taking place. Crucially, the internet and social media have opened the door to instant communication helping women feel less isolation and shame about their experiences.

The Florida Civil Rights Act is designed to prevent discrimination in the treatment of persons, and increase minority representation. It covers fair housing, and creates a Commission on Human Relations. This commission has 12 members appointed by the governor. Its task is to promote and encourage fair treatment and equal opportunity of all people. There should be no discrimination in places of public accommodation, nor should there be unlawful employment practices. Florida Statue 760.10. says if you have been aggrieved, you may file a complaint within 365 days of the alleged violation.
