Guide To Understanding Auto Insurance
The law requires you to have a certain level of car insurance. Although most people follow this, it may be fair to assume that not all of them have a command of what they are paying for—and their degree of protection.
Insurance is protection. It is a means of providing a barrier between you and the uncertainty of driving. When people drive, they assume a degree of responsibility and risk. Without understanding how car insurance works, you will never know to what extent you are protected or entitled.
Personal Injury Protection
In Florida, every driver is required by law to have personal injury protection (PIP) insurance. Additionally, the state mandates you carry at least $10,000 in coverage and $10,000 for property damage liability.
Personal injury protection is blanket coverage for you regardless of who is at fault for an accident. Imagine if someone takes their eyes off the road to turn off the radio. They accidentally drive into your car at a very slow speed. They will likely be responsible for the damage to your vehicle. Hypothetically, the damage and injuries will be minimum. If the other driver had the PIP coverage, they were required to have, the route to obtaining money to fix your car has already been paved. It will come from the PIP insurance. It gets you paid quicker and might prevent you from having to fight the issue in court.
The Minimum Might Not Be Enough
The above example was simple for a reason. A car accident with injuries can quickly escalate beyond the $10,000 in coverage that the other driver had (if they were riding around with the minimum).
Should your injuries and damage exceed that amount, there are other options to obtaining compensation. And they include filing a lawsuit against the at-fault party and going to court. Beyond that, there needs to be a clear and compelling argument centered on proving why the other driver’s negligence caused the crash, and incidentally, your ensuing injuries.
